Agreement to terms

These Terms & Conditions (“Terms”) form a binding agreement between you and BharatNyay for use of our website, APIs, and Online Dispute Resolution platform.

Acceptance. By accessing BharatNyay you agree to these terms. If you do not agree, discontinue use of the platform.
Eligibility. Users must be authorised representatives of parties, neutrals, institutions, or administrators with lawful authority to participate in ODR proceedings.
ODR services. BharatNyay provides technology infrastructure for dispute resolution. It does not provide legal advice, adjudication outcomes, or substitute for qualified counsel.
Account security. You are responsible for safeguarding credentials, MFA devices, and activity conducted under your workspace login.
Case materials. Parties must upload accurate, lawfully obtained documents. Misrepresentation or unauthorised disclosure may result in suspension.
Intellectual property. Platform software, branding, and documentation remain the property of BharatNyay. User content remains owned by submitting parties.
Conduct

User obligations

All participants — parties, neutrals, counsel, and institutional administrators — must use the platform responsibly and in line with applicable law.

No unlawful, harassing, or fraudulent use of hearings, messaging, or evidence tools.

Respect confidentiality obligations tied to mediation, conciliation, or sealed arbitration records.

Comply with applicable Indian law, institutional rules, and contractual ODR clauses.

Do not attempt to reverse engineer, scrape, or disrupt platform availability or integrity.

Report security incidents or unethical neutral conduct through designated grievance channels.

Keep contact, KYC, and organisational details current for service-of-process and notices.

Liability

Disclaimers & limitation

The platform is provided on an “as is” basis. We do not warrant uninterrupted availability but maintain commercially reasonable uptime and security practices.
BharatNyay is not a court, tribunal, or law firm. Outcomes depend on neutrals, parties, and governing clauses — not on the software itself.
These Terms are governed by the laws of India. Courts at New Delhi shall have exclusive jurisdiction, subject to arbitration agreements between parties.

Exclusions

The platform does not undertake negotiation functions unless specifically incorporated within a structured mediation or conciliation process conducted in accordance with applicable law and institutional rules.

We may update these Terms. Material changes will be posted on this page with a revised “last updated” date.
